General Terms and Conditions
§ 1 Scope and Provider
(1) These General Terms and Conditions apply to all contracts you conclude with us as the provider via the online shop at wrestlerstore.com.
(2) The provider is:

(3) A consumer is any natural person who enters into a legal transaction for purposes that cannot predominantly be attributed to either their commercial or independent professional activity (§ 13 BGB). An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into the legal transaction, acts in the exercise of their commercial or independent professional activity (§ 14 BGB).
(4) The customer’s deviating terms and conditions shall not become part of the contract unless we expressly agree to their validity in text form.
§ 2 Conclusion of the Contract
(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order without obligation.
(2) By clicking the “Buy now” or “Place order with obligation to pay” button, you submit a binding offer to purchase the goods contained in your shopping cart.
(3) Receipt of your order will be confirmed immediately by email. This confirmation does not yet constitute acceptance of the offer; it merely documents that your order has been received by us.
(4) The contract is concluded when we accept your order by sending a separate shipping confirmation or when we ship the goods to you. For individually manufactured items, the contract is concluded when we expressly confirm the order, but no later than when production begins.
(5) We store the text of the contract. The contract language is German. If the shop is available in other languages, translations are provided for information purposes only; in case of doubt, the German version shall prevail.
§ 3 Prices and Shipping Costs
(1) All prices stated are final prices and include statutory VAT.
(2) Any additional shipping costs incurred will be displayed separately during the ordering process before you place your order and shall be borne by you unless you effectively exercise your right of withdrawal. The amount of the shipping costs is set out in our Shipping Terms.
(3) For deliveries to countries outside the European Union, additional customs duties, import VAT, and handling fees may apply and must be paid by the recipient.
§ 4 Payment
(1) The payment methods offered during the ordering process are available to you. The payment methods offered in each individual case are shown during the ordering process.
(2) The purchase price is due for payment upon conclusion of the contract unless otherwise agreed.
(3) If you select a payment service provider, its terms and conditions also apply.
§ 5 Delivery and Delivery Times
(1) We deliver to the countries specified during the ordering process.
(2) Delivery times are provided in the respective product description and in our shipping terms. Custom-made items are produced only after the order has been received; the production times stated there must be observed.
(3) Delivery times are approximate unless expressly stated to be binding.
(4) If the goods are unavailable when ordered or are not delivered to us through no fault of our own despite a proper covering transaction, we will inform you without delay. In this case, we will also promptly refund any payments already made.
§ 6 Retention of Title
The delivered goods remain our property until full payment has been made.
§ 7 Right of Withdrawal
(1) Consumers have a statutory right of withdrawal. The details are set out in our withdrawal policy.
(2) The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and whose manufacture depends on an individual selection or determination by the consumer, or that are clearly tailored to the consumer’s personal needs (Section 312g (2) no. 1 of the German Civil Code). This applies in particular to personalized wrestling singlets, individual club designs, and custom-made products.
(3) In addition to the statutory right of withdrawal, we grant a voluntary right of return for non-personalized stock items. The conditions are set out in our return policy. Your statutory rights remain unaffected.
(4) You may declare your withdrawal at any time using the “Revoke contract here” button in the footer of our website.
§ 8 Custom-made items
(1) For personalized items, you are responsible for the accuracy of the information you submit (in particular, name, country code, size, and club design). Please carefully check your entries before placing the order.
(2) You warrant that the content you submit does not infringe any third-party rights, in particular trademark, copyright, or personal rights, and does not violate any statutory prohibitions. We are not obliged to review submitted content for legal infringements.
(3) We reserve the right to reject orders containing unlawful, offensive, or rights-infringing content.
(4) Minor deviations in color and dimensions may occur due to production, provided they are reasonable for you.
§ 9 Liability for defects
(1) Statutory liability for defects shall apply.
(2) For consumers, the limitation period for claims based on defects in new goods is two years from delivery.
(3) Any guarantees provided by us or by manufacturers are in addition to your statutory rights in respect of defects and shall not affect them.
§ 10 Liability
(1) We shall be fully liable for damages arising from injury to life, limb, or health; in cases of intent or gross negligence; in the event of fraudulent concealment of a defect; upon assumption of a guarantee; and under the German Product Liability Act.
(2) In the event of a slightly negligent breach of material contractual obligations (obligations whose performance is essential for the proper execution of the contract and on whose compliance you may generally rely), our liability shall be limited to the foreseeable damage typical for the contract.
(3) Liability is excluded in all other respects.
§ 11 Dispute resolution
We are neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board.
§ 12 Final provisions
(1) The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, the mandatory consumer-protection provisions of that country shall remain unaffected by this choice of law.
(2) Should any individual provision of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
